Also worth bearing in mind any SEO issues presented by fly-outs; if navigational links are hidden in JavaScript this can become an indexing issue. Also if you have a ton of content in your fly-out top level navigation represented in the HTML above the unique page content this may affect each page's ranking potential.

I think that fly-out menus are the work of the devil ;)

What I find most annoying is when you're looking around a page and find a link you want -- which is located somewhere under a navigation menu. So you move the mouse and and overshoot slightly, hovering over the menu. Out goes the menu, obstructing all access to the link you wanted. Now you have to move to the side (preferably left as sub menus may open up on the right!), wait for it to close, and then try to get your link. I don't think you should have to fight an interface to get to where you want ;)

Very nice point you figured out. Most of the menus around there pay no attention to these.
